1. About these Terms
1.1. These Terms of Service are the agreement between You and Geimika MB ("We", "Us") for playing Street Racers 2 at streetracers2.com and in its apps (the "game"). By creating an account, including a guest account, You accept these Terms.
1.2. Processing of Your personal data is described by Our Privacy Policy.
1.3. The English version of these terms is the primary and legally binding version. In the event of a dispute regarding the Terms, the English version shall be applicable. Translations and other versions are provided for the user's convenience.
1.4. Nothing in these Terms limits the mandatory rights You have as a consumer under the law of the country where You live, including Your rights regarding digital content and services.
2. Using the game
2.1. We give You a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to use the game for Your own entertainment under these Terms, and to share content from it as described in section 3 of these Terms (“Intellectual property”). You may not modify the game or create derivative works from it, except for the videos, streams and screenshots allowed in the following section of these Terms.
3. Intellectual property
3.1. The game, including its software, graphics, texts, sounds and the Street Racers and Street Racers 2 names and logos, belongs to Geimika MB or its licensors. These Terms give You no ownership of it.
3.2. You may not use Our names, logos or branding, or confusingly similar ones, in a way that suggests the game, or Your content, product or channel, is made, endorsed or officially connected to Us. This also applies to nicknames, crew names, domains and social media accounts.
3.3. You may create videos, streams and screenshots of the game and share them, including on channels that earn money, as long as You do not suggest that We endorse You and do not show material You obtained by breaking these Terms.
4. Closed beta
4.1. The game is in closed beta. It is unfinished, meaning You may run into bugs, downtime, missing features and frequent balance changes. Access to the beta may be limited, for example to players with an invitation or referral code, and We may end the beta at any time.
4.2. During the beta, or when it ends, We may reset game progress in whole or in part. This can include levels, Gold, Gems, cars, items, crews and rankings. No compensation is owed for a reset, except as set out in paragraph 4.3. Of these Terms.
4.3. If We reset progress, We credit again the Gems You bought with real money, and give back other content You bought with real money (such as bundle items), or Gems of equal value where that content no longer exists. Remaining Garage Pass and VIP time You paid for is kept.
4.4. When You show or share the Game, please make it clear that what You show is a beta version.
5. Your account
5.1. You must be at least 16 years old to create an account and play. If You are under 18, You may make real-money purchases only with the permission of a parent or legal guardian.
5.2. A guest account has no email address or password and works only on the device and browser that created it. If You clear Your browser data or lose the device, the account cannot be recovered. Register Your account to keep it safe. A guest account that has not been used for 12 months may be deleted, together with its progress.
5.3. To access full game capabilities, a regular account may be created. Information provided in the account must be accurate and updated if it changes.
5.4. You must maintain the security of Your account by keeping Your credentials secret. You are responsible for what happens on Your account. Tell Us at support@streetracers2.com straight away if You think someone else has accessed it.
5.5. You may hold more than one account, but You must follow the rules of conduct (Section 9 of these Terms) when using them.
5.6. One account can have a separate profile in each game world. Currency and items belong to the world profile that earned or bought them.
6. Virtual currency and items
6.1. The game contains virtual currencies (such as Gold and Gems), virtual items (such as cars, components and consumables) and statuses (such as VIP). These are not Your property and have no value in real money. You may use them in the game under licence above.
6.2. Virtual currency and items cannot be exchanged for real money, and are not refundable, except where these Terms or the law applicable to it state otherwise.
6.3. You may trade them only through the features the game provides, such as the market and auctions. Trading outside the game is covered in the rules of conduct (Section 9 of these Terms).
6.4. We may correct or remove currency and items You received through an error, a bug or a breach of these Terms.
6.5. Other changes to currencies and items are covered in “Changes to the game and availability” (Section 13 of these Terms).
7. Purchases
7.1. You can buy Gems, bundles and the Garage Pass with real money. Guest accounts cannot make purchases.
7.2. Purchases are sold by Our reseller Tebex Limited, which handles the payment as merchant of record under its own checkout terms. We deliver what You bought to the account and world profile shown at checkout.
7.3. Prices are shown in euro at checkout, including any VAT that applies.
7.4. Content is normally delivered right away. If it has not arrived within 24 hours, write to support@streetracers2.com. At checkout You ask for immediate delivery and confirm that You lose Your 14-day right of withdrawal once delivery has begun.
7.5. If a payment is reversed or charged back, the related entitlement, such as a Garage Pass, ends from that moment. Abusing chargebacks is a breach of these Terms.
8. Garage Pass subscription
8.1. The Garage Pass is a monthly subscription. It renews automatically at the end of each period at the price shown when You subscribed, and Tebex charges You for each period until You cancel.
8.2. You can cancel at any time on the Garage Pass page in the game. After cancelling, Your benefits continue until the end of the period You have paid for, and You are not charged again.
8.3. We do not refund part of a period You have already started.
8.4. A free trial, where We offer one, ends automatically after its period and never turns into a paid subscription by itself.
8.5. If We change the price, We tell You in advance, and the new price applies only from Your next period. You can cancel before then.
8.6. Benefits apply from the moment the subscription is active and are never backdated. Benefits already received are not taken away when the subscription ends.
9. Rules of conduct
9.1. Play fair and treat other players with respect. In particular, You must not:
- 9.1.1. use cheats, bots, scripts, macros, modified clients or any tool that plays for You or gives You an unfair advantage, or manipulate the traffic between the game and Our servers;
- 9.1.2. develop, distribute, or support any cheats;
- 9.1.3. deliberately exploit bugs. If You find one, report it to support@streetracers2.com;
- 9.1.4. share, lend, sell, buy or otherwise transfer an account, or offer or buy accounts, virtual currency, items or services such as boosting for real money or anything else outside the game;
- 9.1.5. use Your own accounts, or other people’s accounts, to move value between them or to gain an advantage, for example by racing, trading or forming crews with Your own accounts, or claiming referral rewards for them;
- 9.1.6. harass, threaten or insult others, or post hateful, discriminatory, sexual, violent or illegal content;
- 9.1.7. share other people's personal data;
- 9.1.8. spam, advertise, run scams or post links to phishing or harmful websites;
- 9.1.9. impersonate other players or Our staff;
- 9.1.10. choose a nickname or crew name that is offensive, misleading or infringes someone else's rights;
- 9.1.11. attack, overload or probe Our servers, or access accounts or data that are not Yours. If You find a security weakness, please report it to support@streetracers2.com instead of using it;
- 9.1.12. copy, decompile or reverse engineer the game, except as far as the law allows;
- 9.1.13. break any applicable law while using the game.
10. Your content and chat
10.1. You are responsible for what You post in the game or send to Us, such as chat messages, nicknames, crew names, build names and descriptions, and screenshots. Except for feedback (see below), You keep ownership of this content, and You confirm that You have the right to post it.
10.2. You give Us a free, non-exclusive, worldwide right to store, display and process Your content created in the Game for as long as needed to run, administer and promote the game, including showing it to other players as described in the Privacy Policy.
10.3. You also give Us the right to show, reproduce and reasonably edit Your builds, screenshots and nicknames on Our website, social media, Discord and other promotional material about the game, credited by nickname. This applies only to Your in game creations and does not apply to You personal data as described in the Privacy Policy.
10.4. If You send Us ideas, suggestions, bug reports or other feedback about the game, We may use them freely, without payment, credit or other compensation, and without any obligation to use them. This applies at all times, not only during the beta.
10.5. You can write to support@streetracers2.com to ask Us to stop using Your content in promotional material or to remove Your nickname from it.
10.6. Global and crew chat are visible to other players. Our moderators can see chat messages and can review private messages that are reported to them. You can ignore and report other players in the chat.
11. Moderation and enforcement
11.1. You can report a player or a message with the report function in the chat, or by writing to support@streetracers2.com. Anyone, including people who do not play the game, can use the same address to report content that they believe is illegal or infringes their rights, stating where they found it and why.
11.2. To keep the game fair and safe, We use automated checks, such as request rate limits, limits on new accounts using global chat, and checks for cheating, together with review by Our staff. If You break these Terms, We may take measures that are proportionate to the breach, such as:
- 11.2.1. removing messages or muting You in the chat;
- 11.2.2. changing an inappropriate nickname or crew name;
- 11.2.3. removing currency or items You obtained in breach of these Terms;
- 11.2.4. suspending Your account for a period of time;
- 11.2.5. permanently closing Your account, for serious or repeated breaches.
11.3. Serious breaches include: cheating, using bots or exploiting bugs for advantage; trading or selling accounts, currency or items for real money; using several accounts to move value or gain an advantage; chargeback abuse, fraud or using stolen payment methods; attacking or attempting to break into Our servers or other players’ accounts; threats, serious harassment, or hateful, sexual or other illegal content; sharing other people’s personal data; impersonating Our staff; and avoiding a suspension or closure by creating another account.
11.4. A breach is repeated if You break the rules again after We have already informed You of a measure taken for a similar breach, or after a suspension. We normally apply lighter measures first, but may close the account at once where the breach is serious.
11.5. We inform You which measure was enforced and why, unless the law prevents it or the content is spam. If You disagree with a decision, write to support@streetracers2.com within 6 months. A person who was not involved in the original decision will review it and reply.
12. Ending the agreement
12.1. You can stop playing at any time and ask Us to delete Your account as described in the Privacy Policy.
12.2. We may suspend or close Your account under the previous section, or where the law requires it. If We close Your account because You seriously or repeatedly breached these Terms, You lose access to its currency, items and remaining subscription time, without refund. If We close Your account for any other reason, We refund the unused part of Your current Garage Pass period.
13. Changes to the game and availability
13.1. We develop the game continuously. To add features, improve balance, fix errors, keep the game fair and secure, or comply with the law, We may add, change or remove features, content, items, currencies, prices, rewards and drop rates. This can change how useful or valuable something is in the game. We will inform You in advance, in the game or by email, about changes that significantly affect what You have paid for. During the beta, changes can be more frequent and We may not announce them.
13.2. We try to keep the game available, but We cannot guarantee that it is always available or free of errors, especially during the beta. We may need to interrupt it for maintenance, updates or security reasons.
13.3. We may stop offering the game, or a game world. Outside the beta, We will tell You at least 30 days in advance where We can.
14. Third-party services
14.1. Some features rely on services of other companies, which have their own terms: payment through Tebex, sign-in with Discord, the app stores You download Our apps from, and Your browser's push notification service. We are not responsible for those services.
15. Changes to these terms
15.1. We may update these Terms, for example when We add features, when the applicable law changes or when the beta ends. The date of the current version is shown at the top.
15.2. We will tell You about important changes in the game or by email at least 30 days before they take effect. If You do not agree with the new Terms, You can stop playing and ask Us to delete Your account before they take effect, and cancel Your Garage Pass.
16. Applicable law
16.1. These Terms are governed by the law of the Republic of Lithuania, and disputes are decided by the courts of Lithuania by the order set out in the Code of Civil procedure of the Republic of Lithuania and other applicable laws.
16.2. If a provision of these Terms is recognised as invalid by the court, the rest of the Terms remain in force.
